If you go by the manufacturer's recommendation and then can't reach maximum
revs, surely they would be obliged to swap it for one with the correct
pitch?  In Australia at least there is "fit for purpose" trade practices
legislation that would cover this as long as you have sought their advice
and not just fronted up and said I'll have that one.
